Terms of Use
1. Parties and subject
This agreement is concluded between the individual Roman Gennadyevich Nadyrov, taxpayer ID (INN) 723018570200, who applies the special tax regime "Professional Income Tax" (self-employed) (hereinafter, the "Rightholder"), and any person who uses the mamaytrading.com site or the MAMAY Trading Terminal program (hereinafter, the "User").
The Rightholder grants the User the right to use the MAMAY program (hereinafter, the "Program") under a simple (non-exclusive) license for personal needs: to install it on their computer and use its features. The free part of the Program is provided free of charge. The Pro subscription and other paid plans are provided under a separate public offer agreement that will be published before sales begin; trial keys for early access members are provided free of charge.
By downloading, installing or using the Program, the User accepts this agreement (Article 1286 of the Civil Code of the Russian Federation). If the User does not agree, they must not use the Program.
2. What MAMAY is and is not
- The Program is a tool for market analysis, record-keeping and automating the User's actions. The User makes all trading decisions themselves.
- Neither the Program, nor the site, nor support, nor the Program's mentor provide individual investment advice, manage the User's funds, or act as a broker, exchange or investment adviser.
- Screener signals, calculations and examples show what the Program sees in market data and are not a promise of returns. Past results, including on a DEMO account, do not guarantee future ones.
- Trading financial instruments, including cryptocurrencies, stocks and derivatives, carries a high risk of losing capital.
3. Exchange keys and real mode
- The Program runs on the User's computer. Exchange keys are stored there in encrypted form and are sent only to the corresponding exchange; they are not transferred to the Rightholder.
- After launch the Program works in DEMO mode. Real orders and transfers are executed only after the User turns on real mode themselves; the User sets the exchange key permissions themselves in the exchange account.
- The User is responsible for the security of their keys, passwords and devices, and for complying with exchange rules and the laws of their country.
4. What is prohibited
- to reverse engineer, decompile or modify the Program, or bypass the subscription key check, except where expressly permitted by law;
- to transfer, sell or publish subscription keys and copies of the Program to third parties;
- to use the Program, the site, the support chat and the community to break the law, send spam, manipulate the market or harm other users.
5. Liability
The Program is provided "as is". The Rightholder strives to make it work accurately and without interruption, but does not guarantee the absence of errors, market data delays, or failures of exchanges and third-party services. To the extent permitted by law, the Rightholder is not liable for the User's losses or lost profits arising from trading decisions, from the actions of exchanges, networks and third-party services, or from using the Program in breach of this agreement.
6. Personal data
The Rightholder processes personal data under the Personal Data Processing Policy and only with the User's consent, given separately.
7. Changes and disputes
The Rightholder may change this agreement; a new version takes effect from the date it is published on this page. This agreement is governed by the law of the Russian Federation. Disputes are resolved through negotiation, and if no agreement is reached — in court at the Rightholder's place of residence, unless otherwise provided by consumer protection law.
